Mayor Mueterthies informed the council, Frank Wilson found grants for the water project to apply for.  Nick LaRosa with Fehr Graham Engineering informed the council they can help with the grant applications.  Fehr Graham will need to re-estimate the water project.  The new well location will be moved to help with the cost of the project.

 

Nick LaRosa also gave updates on the culvert project in town.  The project is currently behind schedule due to the rain.

 

Motion made by Scheidel to accept the Partial Pay Estimate number two for Bacon Concrete, LLC.  Seconded by Roberson.

Samantha Njus explained issues with her house electricity.   She would like the city to pay a portion of her bill with Ryan Meier Electric.  Motion made by Wilson for the city to pay $150.00 towards Samantha’s bill form Ryan Meier Electric.  Second by Scheidel.

Mayor Mueterthies discussed Nuisance properties within the city.  Letters will be sent to property owners.

 

Fixing the curb and gutter in front of city hall has been put on hold for 2 years.

Nick LaRosa with Fehr Graham went over the Preliminary Engineering Report for the Water System Study. The city will need a new well.  The council discussed the expense related to this project and will need to raise water rates.  Motion made by Croell to set a Public Hearing July 1, 2024 at 7:15pm to update the Ordinance to increase city water rates.  Seconded by King.

Renea Huinker with the library informed the city Steve Lynch will no longer be on the library board and his replacement will be Randy Kuennen. Motion mad by King to accept Randy Kuennen to a 6 year term with the Lawler Library Board.  Second by Croell.

Renea also informed the council the library will have an open house Saturday, June 15, 2024 from 2:00pm – 5:00pm during Irish Fest.  A St Croix Hospice meeting will take place June 19, 2024 at 10:30am in the library.  She also informed the council the library would like to use memorial money to have a Story Walk around the trail at Highland Park.

 

Motion made by Scheidel to accept the purchase agreement from Bodenstiener Implement for the purchase of a lawn mower.  Second by Croell.

Suzette spoke with Dana Davis with the Office of Auditor of State regarding the annual examination.  Miss Davis informed Suzette the city will need to send out a request to at least 2 CPA firms in the area.  Motion made by King to call Hacker Nelson and Bergen Paulson.  Second by Croell.

Fehr Graham sent a change in contract from Bacon concrete to remove old wall and replace with new.   They will add area intake behand wall and outlet pipe through new wall.  With this change order will be an increase of $33,780.00 to contract price.  Motion made by Scheidel to accept the change order presented.  Seconded by Croell.

John Cuvelier with Insurance Associates discussed the current renewal insurance policy.  The premium had increased around $537.00.  He let the council know if the current deductible for wind and hail damage to property for $2,500 was increased to $5,000 it would save the city $1,300 per year of premium savings.  Motion made by King to increase insurance deductible to cover wind and hail damage to property.  Second by Roberson.

Leon Begay with INRGOG explained the Update for Chickasaw County Multi-Jurisdictional Hazard Mitigation Plan.  There were no comments regarding the Hazard Mitigation Plan.

Renea Huinker gave an update on the library renovation.  Currently there are 12 new patrons using the library.  The library plans to be open during Irish Fest for the open house.  The library purchased shades for the front windows.  The two new windows are leaking and will be getting fixed.

 

Lucas Elsbernd with Fehr Graham gave the council paper copies of the changes discussed last month with the council.

 

Lee Moorman informed the council he has had the electricity and water turned on for his property at 203 S Center St.  He is asking for more time to clean up property. He informed the city council he does not have the funding.  This project will take time.  Motion made by King to give Mr. Moorman 90 days to show improvement and have a plan to clean up property or the city will continue with a nuisance abatement,  Second by Roberson.

The city receive a letter from the Office of the Auditor of State inform the city the city is required to have and annual examination for the fiscal year ending June 30. 2024.  Suzette will be contacting the Dana Davis with the Office of Auditor of State for the state to perform the annual exam.

 

Mayor Mueterthies was questioned regarding voting in Lawler.  After some research he received information about Satellite Absentee Voting.  Satellite voting stations provide in-person voting at other places other than the auditor’s office.  The city may request a satellite station by filing a petition with the county auditor.  The petition must contain signatures of 100 eligible electors living in the jurisdiction.  If this came to Lawler, we would need volunteer workers.

NOTICE OF PUBLIC HEARING

 

Notice is hereby given that on the 6th day of May 2024 at 7:15 p.m. the City Council of Lawler, Iowa will hold a public hearing at the 414 E Grove St to accept input regarding the draft Chickasaw County Multi-Jurisdictional Hazard Mitigation Plan, recently adopted by the County.  Specifically, the hearing is to obtain citizen comment on the Plan prior to the City Council approving their participation in the Plan and adoption thereof.

 

Anyone interested may appear at the above stated time and place for the public hearing and be heard or may file written comments in person or mail to the City Clerk, of Lawler, Iowa at the 414 E Grove St Lawler, IA  52154.  Written comments must be received in the City Clerk’s office before 10:00 AM on the date set of said hearing.  A copy of the plan is available for review at City Hall.

Ryan Wicks with Fehr Graham explain to council a formal change order for the box culvert project.  Motion made by Croell to accept change order from Fehr Graham.  Second by Roberson.

James Bailey discussed the dead trees to be removed on his property.   He plans on taking the dead trees down.  One pine tree is still green and he will take it down if it starts turning brown.

 

Property located at 107 S. Benz St is still in abatement.  The property owners have started cleaning the property.  The property will stay in abatement until the house is taken down.

Property located at 203 S Center St has been sent to lawyer for abatement process.

Property located at 2004 Union Avenue had a complaint against the property owner.  The property owner said it was not in city limits.  Mark will call the county to double check if the property is in city limits.

Property located at 101 W Spring St was updated.  Property owner is planning to put a steel roof on garage.

The council asked to send nuisance letter to two property owners within the city.

 

The city will not be paying for any tree removal for property owners and set up payment plan.  The tree removal is the property owner’s expense.

 

Motion made by Scheidel to set Public Hearing for Hazard Mitigation for May 6, 2024 at 7:15pm.  Second by Croell.

Jane Lynch and Cathy Humpal updated the council regarding the library expansion.  The library is waited for the grant request and said should be hear sometime in March.  The library is planning on having an open house either in April or May.

 

King discussed a city garage sale and can drive with donated items for sale to raise money for Christmas lights during spring clean-up.  It was decided to just have a can drive.  The city would like spring clean-up to be April 20^th or April 27^th depending what would be available for Jendro to bring the dumpsters.  Suzette will call Jendro.

 

Motion made by Scheidel to open Public Hearing to accept Box Culvert bids.  Second by King.

Nick LaRosa with Fehr Graham presented the bids for the replacement of the box culverts within the city.

 

Motion made by King to accept the 4 bids for 4 culverts from Bacon Concrete LLC of Postville, IA for $815,665.50 for the base bid work.    Second by Roberson.

The nuisance abatement for the property located at 205 N Center St was discussed.  The property owners will be taking the house down end of March 2024.  The garage on the property will be painted and new window installed.  The willow tree on the property will be cut down.

 

The council discussed other nuisance letters to be sent to property owners.  Suzette will be sending nuisance letters to property owners.

 

There are several deceased trees on home owner’s property.  A list of the property owner’s deceased trees was presented to the council.  A letter will be sent to the property owner’s with deceased trees on their property.  The property owner will have 60 days from the date of the letter to remove the tree or speak with Mayor Mueterthies or any council member.

 

The council discussed helping the Lawler Lions and Sons of a Legion fund a digital sign in the City of Lawler to be located on the Key Car Wash property
