The Lawler City Council met in special session on April 1, 2024 at 7:00 PM.

 

Mayor Mark Mueterthies presided.

Motion made by King to approve the Agenda

Second by Croell.   All Ayes.  Motion passed.

 

Motion made by Scheidel to open public hearing on Proposed Property Taxation for Fiscal Year July 1, 2024 – June 30, 2025. Second by Roberson,

Motion made by Scheidel to approve the previous minutes with corrections: The nuisance abatement for the property located at 205 N Center St was discussed.  The property owners will be taking the house down end of March 2024.  The garage on the property will be painted and new window installed.  The willow tree on the property will be cut down. *** should read ***the nuisance abatement for the property located at 107 S. Ryan Wicks with Fehr Graham explain to council a formal change order for the box culvert project.  Motion made by Croell to accept change order from Fehr Graham.  Second by Roberson.

James Bailey discussed the dead trees to be removed on his property.   He plans on taking the dead trees down.  One pine tree is still green and he will take it down if it starts turning brown.

 

Property located at 107 S. Benz St is still in abatement.  The property owners have started cleaning the property.  The property will stay in abatement until the house is taken down.

Property located at 203 S Center St has been sent to lawyer for abatement process.

Property located at 2004 Union Avenue had a complaint against the property owner.  The property owner said it was not in city limits.  Mark will call the county to double check if the property is in city limits.

Property located at 101 W Spring St was updated.  Property owner is planning to put a steel roof on garage.

The council asked to send nuisance letter to two property owners within the city.

 

The city will not be paying for any tree removal for property owners and set up payment plan.  The tree removal is the property owner’s expense.

 

Motion made by Scheidel to set Public Hearing for Hazard Mitigation for May 6, 2024 at 7:15pm.  Second by Croell.

Motion made by Scheidel to accept the 28e agreement with the Chickasaw County Sheriff Department for drive through service. Second by Croell.

Jane Lynch and Cathy Humpal updated the council regarding the library expansion.  The library is waited for the grant request and said should be hear sometime in March.  The library is planning on having an open house either in April or May.

 

King discussed a city garage sale and can drive with donated items for sale to raise money for Christmas lights during spring clean-up.  It was decided to just have a can drive.  The city would like spring clean-up to be April 20th or April 27th depending what would be available for Jendro to bring the dumpsters.  Suzette will call Jendro.

 

Motion made by Scheidel to open Public Hearing to accept Box Culvert bids.  Second by King.

Nick LaRosa with Fehr Graham presented the bids for the replacement of the box culverts within the city.

 

Motion made by King to accept the 4 bids for 4 culverts from Bacon Concrete LLC of Postville, IA for $815,665.50 for the base bid work.    Second by Roberson.

Ayes: King, Roberson, Wilson and Scheidel.

The council discussed other nuisance letters to be sent to property owners.  Suzette will be sending nuisance letters to property owners.

 

There are several deceased trees on home owner’s property.  A list of the property owner’s deceased trees was presented to the council.  A letter will be sent to the property owner’s with deceased trees on their property.  The property owner will have 60 days from the date of the letter to remove the tree or speak with Mayor Mueterthies or any council member.

 

The council discussed helping the Lawler Lions and Sons of a Legion fund a digital sign in the City of Lawler to be located on the Key Car Wash property

Ryan Wicks and Nick LaRosa were here to present the council with the plans for the Box Culverts construction.  They went through each culvert with the council and answered questions.

 

Renea Huinker showed the council the updated library.  She explained they are still waiting on a grant she applied for to help the library with expenses.

 

Mayor Mueterthies told the council he asked John Izer to be on the Board of Adjustment and he agreed.  Motion made by Croell to appoint John Izer to the Board of Adjustment.  Second by Scheidel.

Motion passed.

 

The council discussed the Public Hearing for the Proposed Tax Rate for FY24/25.  Suzette explained to the council this Public Hearing will need to be a separate council meeting.  Motion made by Wilson to have the Public Hearing for the Proposed Tax Rate April 1, 2024 at 7:05pm.  Second by King.

Motion passed.

 

Suzette presented the counsel with the Budget FY24/25 for their review.  She explained to the council that property tax went because of the Debt Levy since the city had a new loan for the box culvert project.

 

Wilson informed the council of a citizen burning and said not just wood.  A nuisance letter will be sent to resident with a copy of the ordinance.
