The Lawler City Council met in regular session on February 5, 2024 at 6:00 PM.

 

Mayor Mark Mueterthies presided.

Ryan Wicks and Nick LaRosa were here to present the council with the plans for the Box Culverts construction.  They went through each culvert with the council and answered questions.

 

Renea Huinker showed the council the updated library.  She explained they are still waiting on a grant she applied for to help the library with expenses.

 

Mayor Mueterthies told the council he asked John Izer to be on the Board of Adjustment and he agreed.  Motion made by Croell to appoint John Izer to the Board of Adjustment.  Second by Scheidel.

The council discussed the Public Hearing for the Proposed Tax Rate for FY24/25.  Suzette explained to the council this Public Hearing will need to be a separate council meeting.  Motion made by Wilson to have the Public Hearing for the Proposed Tax Rate April 1, 2024 at 7:05pm.  Second by King.

Suzette presented the counsel with the Budget FY24/25 for their review.  She explained to the council that property tax went because of the Debt Levy since the city had a new loan for the box culvert project.

 

Wilson informed the council of a citizen burning and said not just wood.  A nuisance letter will be sent to resident with a copy of the ordinance.

Cole Roberson has agreed to fill Gwen Kuehner’s council seat after her resignation.  Motion made by Scheidel to appoint Cole Roberson to the council to replace Gwen Kuehner’s council seat.  Second by King.

Dave Burns cleaned up under the city culvert near his house.  The City did not hire him to do this work and he did not get paid for this.  Kurt Croell thanked him for his volunteer work.  Mr. Burns also handed out a flier regard a Lawler TEAM Challenge to volunteer to help cleanup Dry Run Creak through town.  Suzette stated the property owners along the creek receive letters to clean up their half of the creek that runs along their property.

 

Renea Huinker with the Library Board gave the council an update on the library remodel.  The furnace room has been moved and is functional.  The outside windows to the south and west have been installed.   The library will be applying for a grant the Chickasaw Foundation.  She informed the council the winter hours for the library will be closing at 4:30pm.

 

Mayor Muetherthies informed the council the city will need a new air conditioner in the city hall.  Mic’s Plumbing & Heating informed him a coil was rusted in current air conditioner.  Motion made by Croell to purchase a new air conditioner.  Second by King.

Lucas Elsbernd sent the council a schedule for the Box Culvert Improvements. The council needs to date and time for bid opening for the Box Culvert Improvements projects and set date and time for the public hearing on the proposed Contract Documents and Estimated Costs for the Box Culvert Improvements project. Motion made by Croell to set bid opening date February 28, 2024 at 10:00am. Second by Wilson.

Chickasaw County Supervisor Travis Suckow was at the meeting.  Croell was asking why the City of Nashua received the $50,000 to fix their damn.   Travis also voted to give $50,000 to the secondary roads near Alta Vista.  Croell asked Mr. Suckow to start representing his district.  The City of Lawler could use some help with the replacement of the 4 box culverts within the city.

 

The council worked on the Budget FY24-25.  Street repairs were discussed.  Not much will be able to be done this year since the box culverts are being replace.  Jendro Sanitation raised their prices of the garbage pickup.  Jay stated increase in chemical prices for the water, sewer and parks.  Suzette will run the numbers the council gave.  Budget numbers will be discussed next month.

Mark notified the Council of an invoice from Dave Burns for moving dirt from under the Lincoln Street culvert.  The City did not hire him to do this.  He did the work on his own time.  Suzette will type a thank you letter and Council man King will deliver and talk with Dave Burns.

 

Counsel Gwen Kuehner has resigned from the remainder of her term on council.  The city would need to appoint a new person to take the remainder of her term which ends December 31, 2025.  Dale has talked with a fee residents about taking over Kuehner’ term.  Kurt will talk with Cole Roberson about taking over the term.

Suzette presented Budget Worksheets FY 24-25 to the Mayor, Council and Jay to start gathering upcoming expenses.  The city will need to budget for the box culvert repair, water improvement system and street repairs.  It was brought to the attention the current lawnmower is ending and would need to look for a new one.  The city will need prices.  This will be discussed further at next month’s meeting.

 

Suzette mentioned small cities are putting speed traffic cameras on main highways through the city.  The city would receive a percentage of any traffic tickets sent.  This money could be used for and city fund.  Kurt mentioned that people may not want to come back to Lawler if they receive a ticket because of speed camera.

 

Jay explained to the council the nitrates within the city well are high and it has been recommended to him the city would need to dig a deeper well.  The city received a Water System Study proposal from Fehr Graham. The cost will be $19,500 with all plan reproduction and distribution costs along with publication and permit fees will be paid direct by City and are not included in the $19,500.  The current budget was checked and the city can pay the $19,500 this fiscal year.

Motion made by Croell to accept the Fehr Graham Water System Proposal agreement. Second by Scheidel.

Renea Huinker with the Library explained the library received a $10,000 check for the McElroy Grant.  She stated the library is working with Stanton Electric to improve the lighting in library.  The board is working with Midwest Flooring for new carpet.   She also stated she received a quote from Mic’s Plumbing & Heating for a new air conditioner for the library.  She had stated it is not in the library budget for an air conditioner and would like the city to pay for this.  This is not in the city budget for this expense.  Motion made by King to table the air conditioner unit expense until July 2024 FY 24-25. Second by Izer.

The library board presented the council with a list of items in the community room.   The council will go through the list and decide what to keep.  They will discuss at next meeting.

 

Renea said she checked with the Iowa Library about use of the library for the Chickasaw Board of Health to give flu shot when the library is closed.  Renea said she is will to work with them.  Renea also stated the library board 1205 is not ready to sign the Agreement to transfer room to Library.  She would like the library attorney to look at.

 

Ordinance #69.12 Outdoor Storage of Motor Vehicles what discussed with council.  The council was going to change the ordinance to allow 2 vehicles per licensed driver on the property.  After discussion the council decided that would be too many cars that could be stored on property.  Motion made by King to keep original ordinance as stated in the Ordinance Book.  Second by Scheidel.

The city had filed a nuisance infraction against property owners at 107 S Benz St (house) and 105 S Benz (garage).  The city attorney sent a copy of the Municipal Infraction. The council reviewed the draft.  Motion made by Scheidel to continue with the abatement process.  Second by Izer.

Motion passed.

 

John Izer explained to the property owners the council said they can keep the race track in their yard if they put a fence up around the track or they will need to make the tack grass.  The property owner asked if they could decide next spring.  Motion made by Scheidel to table the nuisance at 307 E Spring St until spring of 2024,  Second by Izer.

The Annual Financial Report was presented to council for review.  Motion made by Scheidel to approve the Annual Financial Report.  Second by King.

The city received surveillance camera quotes from Iowa Surveillance Team for cameras in Croell Park, Junk Park and the front of City Hall.  Suzette said it would be in the budget numbers for FY 23-24.   The council will need to watch the spending in the Culture and Recreation fund.

Motion made by Scheidel to install cameras in Croell Park, Junko Park and front of City Hall. Second by Izer.

Jay reported the bridge on Lincoln Street had been cleaned up November 6, 2023.

 

Kurt Croell cleaned up the water way through town.  A big thank you to Kurt for doing the clean-up.  The council discussed sending letters to property owners to keep the water way cleaned up going through your property.  Motion made by King to send the letters to property owners with copy of Ordinance stating it is property owner responsibility.  Second by Scheidel.

Jay presented council with a quote from Rosenbaum Auto and Sandean for new tires for the city truck.  The council reviewed each quote.  Motion made by Izer to accept Rosenbaum Auto.  Second by Scheidel.

Renea Huinker explained the library board is continuing to work on designed layout.  The contractors will be in October 6, 2023 in the afternoon to start working on changes.  The library has applied for a $50,000 Grant.  The grant review is October 19, 2023.

 

The council discussed Ordinance #69.12(1) Outdoor Storage of Motor Vehicles.  Motion made by King to change Ordinance #69.12(1) to permit the parking of  2 registered vehicles per licensed driver out-of-doors for more than 30 days.  Second by Izer.

The council discussed Ordinance #155.04 Property Maintenance.  Suzette explained to the council she spoke with the City Attorney regarding this ordinance and he doesn’t think the current ordinance needs to be changed.  He said the ordinance needs to be enforced.

 

Nuisance at 307 E Spring St. was discussed.  The property owners sent a letter regarding the Nuisance letter they received.  Counsel person Izer said he spoke with the property owners regarding the race track in back yard.  Motion made by Croell to send a letter to property owners to either eliminate race track or they need to put of 7ft fence up and have the track fully enclosed.  John volunteered to deliver letter.  Second by King.

Mayor Mueterthies gave an update regarding the current nuisance abatement at 205 N Center St.  The city is currently waiting for the court date.  The mayor and one counsel person will be required to testify on behalf of the City.

 

Mayor Mueterthies updated the council regarding the box culvert loan.  Mayor Mueterthies and Jay Uhlenhake spoke with Mark Newell an aide to Governor Reynolds.  Mayor Mueterthies informed them the information has been sent to engineers.  Jay has received the locates so the engineers will be in Lawler.

 

The waterway through town will need to be cleaned out.  The property owner’s along the waterway are responsible for cleaning their side of the waterway.  This will be tabled until November meeting.

Mark made a comment; he has talked with John Cuvelier regarding the city insurance increase.  John will be at next council meeting to discuss.

The Lawler Library board discussed the Library expansion project.   Renee Huinker explained they would like to put a wall in the back meeting room of the city community room.  A needs assessment should be done by the state library before any action be taken.  The council let the library board know the city attorney would be called because they would need a contract with city for the use of the room.    There have been families using the community for holidays.  The city will need the room available for any emergencies that should arise within the city.  The city will need a public hearing to hear public opinions because this is a public building.

The city requested consideration for the state Contingent Fund loan for damages sustained under the governor’s proclamation 2021-17 dated August 30, 2021.  The flash flooding occurred on August 28, 2021 and caused significant damage to the city’s infrastructure resulting in the city needing to replace multiple culverts within the city to repair flood damage at an estimated cost of $1,377,070.  The city work with Iowa Homeland Security and Iowa Northland Regional Council of Governments for a federal grant for funding.  These efforts have not been successful.  The city has been approved for a state contingent fund loan to make repairs necessary to the city’s infrastructure.  The city will receive a loan for 1,000,000.00 to be paid over the next 20 years.

Trees Forever and Black Hills Energy will be planting trees within the city May 6, 2023.  Would like volunteers.  Suzette will be checking with Turkey Valley for student volunteers.  If you would like to volunteer, let Suzette know at the city hall.

 

Nuisances within the city were discussed.  The city has several dangerous buildings or structures that are structurally unsafe.  Mayor Mueterthies read the ordinance regarding Dangerous Buildings, Chapter 145 in the City Ordinance book.  The city will be sending by certified mail written notice to property owners.  The property owner will have 48 hours to commence either the required repairs or improvements or demolition and removal of the building or structure.  All work will be completed within 90 days from date of notice or the owner can request a hearing before the Council by filing a written request within the 90 days.

AN ORDINANCE AMENDING SECTION 6-5-20 OF THE LAWLER MUNICIPAL CODE REGARDING REFUSE AND RECYCLING COLLECTION RATES FOR THE CITY OF LAWLER.

 

BE IT ORDAINED by the City Council of the City of Lawler, Iowa as follows:

 

Title VI, Chapter 5, Section 6-5-20 of the Municipal Code of the City of Lawler, Iowa, is amended by the following:

 

Section 6-5-20 Rates: There are hereby established rates for refuse and recycling collection supplied by the City of Lawler as follows:

 

Residential Rates

 

For a 35 gallon tote the monthly rate is: $14.05
For a 64 gallon tote the monthly rate is: $15.17
For a 96 gallon tote the monthly rate is: $17.02
Recycling (Residential) monthly rate is: $3.00 per dwelling unit.

 

Repealer. All ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.

 

Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall :not affect the validity of the Ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional.

 

When Effective.       This Ordinance shall be in effect upon its passage, approval and publication as provided by law.

Sheriff Ryan Shawver with Chickasaw County discussed the Agreement for General Law Enforcement Services.  The City will pay the County $6,090 (rate of $15.00 per person) for general law enforcement services during the term of the service agreement, July 1, 2023 – Jun 30, 2024.  There are no set hours, only drive through services.

Cathy Humpal discussed the library expansion.  She let the council know she took a survey regarding the library needs.   She said they would like a more comfortable place and more room and more privacy.  She stated she had a case worker and a client meet there for a private conversation.  Cathy also stated there were people complaining regarding the sand and salt on the curb and these people did not like walking through it.  Suzette gave her a Citizen Complaint Form for these people to fill out and return to the city clerk, mayor or any council.  No form was filled out.  She didn’t think people should fill this out.  She stated she should not be doing city maintenance work.  She also made a comment regarding the City Hall hours.  Some residents come to pay after 3:00pm.  Suzette stated they could put payment in bill box or pay by credit/debit online.  No decisions were made so this will be tabled until the April meeting.

Dale King told Cathy he called the city attorney regarding some comments at February meeting regarding privacy around the library computers and people who could be looking at porn and little children could see because of the lack of privacy.  Dale informed Cathy that is not allowed in a public building according to the city attorney John Anderson.  He said the city IT tech will care of it.  Dale also stated if people have a problem with the street cleanup they are to come to the city.

 

Mark received a bid from Blazek Corporation to replace a box culvert on N Benz St and cleanout and shape drainage channel on the north side of town.  It is the homeowner’s responsibility to clean the ditches.

Street maintenance was discussed.    Chestnut St. from Pitts St to Hwy 24 will be resurfaced in FY22/23 to be completed before June 30, 2023.  W.  Pitts St from Chestnut St to Brown Street will be resurfaced FY23/24.

 

Motion made by Kuehner to use ARPA money for the street maintenance for W Pitts St. from Chestnut St. to Brown St.  Second by King.

The curb along Grove St in front of City Hall and the curb on S Depot St along Insurance Associates need to be maintained.  Motion made by King to maintain the curbs along Grove St. and S Depot St along Insurance Associates.  Second by Scheidel.

A letter will be sent out to homeowners to clean up the portion of the water way along their property.

 

The city received a grant from Trees Forever.  Suzette will be in contact to the residents who reached out to her for a tree for $25.  You will not be allowed to plant within the boulevard (8ft from street)

 

Mark presented the Chickasaw County Firefighting Mutual Assistance Agreement for the council to review.  Motion made by King to accept the Chickasaw County Firefighting Mutual Assistance Agreement.  Scheidel second.

Utility payment agreement was discussed.  Suzette reached out to City Attorney John Anderson. The city can decide the date the past due needs to be paid in full by.  If the customer doesn’t agree, but doesn’t disputed the bill, service can be disconnected as long it is not from November to April and prior notice has been given to the customer that if past due amounts are not paid, service will be disconnected.
