NOTICE OF PUBLIC HEARING

ON PROPOSAL TO VACATE AND CONVEY CITY-OWNED REAL ESTATE

 

The Lawler City Council will hold a public hearing on January 3, 2022, at 7:15 p.m. local time in the meeting room of the Lawler City Hall located at 414 E Grove St, Lawler, Iowa to hear comments for and against proposal to vacate and convey City-owned real estate to Croell, Inc., and more specifically described as follows:

 

A parcel of Diagonal Street described as follows:

 

Right-of-Way Reversion Parcel #1, Project Number: 2021 Diagonal Street in the Southwest Quarter of the  Southeast Quarter of Section  4, Township 95 North, Range 11 West of the  5th P.M., City of Lawler, Chickasaw County, Iowa, and  more  particularly described as follows:

 

Commencing at the South  Quarter Corner  of said Section;

 

Thence  North 88°16’02” West, 130.97 feet along  the  Centerline of Iowa  Highway 24;

 

Thence  (C2) Northeasterly 847.29 feet along a 1145.92 foot  Radius Curve, Concave  Northwesterly (said  Curve  having a long  chord  of North  67°05’06” East, 828.12 feet)  along  said Centerline to the Southerly Extension of the  Northeasterly Right-of-Way Line of Diagonal Street;

 

Thence  North 42°10’48” West, 50.03 feet along  said Southerly Extension to the Intersection of the North  Right-of-Way Line of Iowa  Highway 24 and the  Northeasterly Right-of-Way Line of Diagonal Street;

 

Thence  continuing North 42°10’48” West, 42.08 feet along  said Northeasterly Right-of-Way Line to the  Point of Beginning;

 

Thence  South 56°43’19”  West, 7.97 feet;

 

Thence  North 33° 16’41” West, 50.89 feet to said Northeasterly Right-of-Way Line;

 

Thence  South 42°10’48” East, 51.51 feet along  said Northeasterly Right-of-Way Line to the Point of

Beginning.

 

Containing 203 Square Feet, subject to any easements recorded or unrecorded.

 

(hereinafter referred to as “Vacation Parcel”)

 

That if the City Council does approve the vacation of the Vacation Parcel, that the City proposes to convey said Vacation Parcel to Croell, Inc., by a properly executed Quit Claim Deed and that said conveyance shall be “as is”, for the consideration of $500.00 and payment of all City expenses related to the transaction, including but not limited to legal fees and publishing costs, as well as the City reserving a utility easement upon and across the Real Estate.

 

At said time and place, comments will be received at the public hearing by the City Council on the question of the vacation and conveyance of said parcel of real estate.

 

This notice is published at the direction of the Lawler, Iowa City Council.

Kurt Croell had Herold-Reicks Surveying survey the new build at Bucky’s.  The building is on a portion of city property.  Kurt Croell informed the city he will purchase the property for $500.00 and take care of all expenses to sell.

Motion made by Izer to sell property to Kurt Croell for $500 and all expenses.  Second by King.

Motion passed.

Mark Mueterthies, Jay Uhlenhake and Kurt Croell met with Iowa Homeland Security and Emergency Management for state funding for flooding.    The city is working with them for funding to make the channel wider going through town.  Some property may be lost to do this project to help flooding within the city.

Cathy Humpal discussed security cameras for the library.  The company the library is going through wanted to know if the city would be interested.   The library said they have a quote for $3,000 and plan to cash in a CD to pay for it.

Suzette explained Northeast Iowa Community Action Corporation is launching a new program. LIHWAP an emergency program that will help low-income households and families afford water and wastewater services.  This is to help residents pay past due water and wastewater bulls, avoid shutoffs, and regain disconnected accounts.

The council reviewed the Farm Lease with John Brincks to decide when they are ready to approve lease.  This will be on December agenda.

The furnace that heats the library and community room is 30 years old and the controller went out and is too big.  The city received bids from Geerts Plumbing & Heating and Mic’s Plumbing and Heating.  We could possibly sell the old finance.

Motion made by Croell to approve Mic’s Plumbing and Heating bid.  Second by Izer.

Mark gave an update on the Chickasaw Ambulance.  The contract will terminate June 2022.  The next ambulance meeting will be November 21, 2021.

Mark is trading his personal ranger with Drillings and is working out for Drillings to sell to city.  He would like a consensus with council on the December agenda.

Jason Byrne can no longer represent the City of Lawler on the Turkey River Watershed Board because it would be a conflict of interest because he represents Chickasaw County.  Suzette Byrne let the council know she would represent City of Lawler.

Dick Schnorenberg discussed having the city clean out the ditches which were filled in by private owners and requested it be done by April 2022.  Jay informed the council Blazek’s had gave a quote to clean Lincoln St. ditch this fall.   Kurt Croell informed the council Iowa Homeland Security will be here October 28, 2022 to look at all the problems within the city.  Some of the problems include the culverts, and clean the waterway to slow the water through town.  This will include the help from property owners.   Iowa Homeland could fund up to 25% of the expense.  Kurt informed the council the governor’s office will assist. This will be put on the November agenda after professionals look at the city.

John Brincks will rent the farm at $4,000 for one more year.  He will them rent for $4,800 per year for the next 3 years.  City attorney John Anderson will write up a new farm lease contract to reflect the change in payment.

Concession stand expenses to clean up after flood will be around $1400.00.  Chris Rigel will fix the concession for $500.00.  John Izer said he will pay half to cost.

Scheidel made a motion to have Chris Rigel to fix the concession stand.  Second by Kuehner.

Mark said Chris Rigel will attach the vinyl base up on the walls.  It was brought up purchasing new carpet for the meeting rooms in the city hall.  Suzette said it is not in the General Fund for City Hall for the current fiscal year.  The council will be waiting until spring for trim board.

Kurt Croell spoke with the Department of Agriculture to work on cleaning out the creek running through town.  There is grant money out there to help with the expenses.  The city needs a long term solution for the flooding problem in town.  Need to slow done the volume of water running through the creek.  The Department of Agriculture will review and recommend a solution for cleaning out the creek.   Council discussed priorities in fixing damage from the flood.  The dike in Junko Park was damaged and needs to be fixed.  The city will talk with Blazek Corporation for a bid to fix the dike.  The lagoons were also damage and need fixed.

Dick Schnorenberg discussed the culvert on his property.  He stated the culverts need to be updated.   Jay received a bid from Blazek Corporation for $2,000.  Dick also discussed the manholes in the city need to cleaned out also.  The council tabled this until next meeting.

A copy of the Code of Ordinances will be in city hall for public to review.

Motion made by King to set Public Hearing to approve the Code of Ordinances on October 4, 2021 at 7:15p.m. Second by Croell.

Trisha Wilkens explained the 28e agreement with the NEICA.  The state auditor is requesting the NEICA to have a 28e agreement with Public entites to non-profits.  This is so public entities will know where the city’s contribution is spent.  The city will not have an obligation to pay anything to the NEICA.

Code of Ordinances – Flood Plain Chapter

The council discussed the Flood Plain Chapter from Simmering Cory.  After review, the council agreed to accept the Flood Plain Chapter.

Resolution No. 2021-08022021 was discussed to transfer funds from Water improvement fee fund, Sewer improvement fee fund and electric improvement fee fund to the water, sewer, and electric cash funds.  The money will be used for the cost of the radio read meters.

Motion made by Kuehner limited motor truck, semi-trail or other motor vehicle with trailer be left standing or parked upon any street, alley, public or private parking lot, or drive of any service station between the hours of 10:00pm – 6:00am.with engine, auxiliary engine, air compressor, refrigerating equipment of other device in operation giving off audible sounds excepting only the drive of service station when actually being serviced. And the in no event for mot than 30 minutes.    Second by King.

Aaron Trezona with the Tree Doctor Services discussed the Ash Trees in the park.  The trees are infected with Emerald Ash Borer (EAB).  This can kill the trees if not treated.  Jay will remain in contact with Aaron Trezona since he will look at the city trees and then resident’s trees.

Stephanie Tangen discussed a nuisance of her neighbor burning brush and the smoke blowing into her house.  Since it is against City Ordinance #6-4-4, a letter will be sent to homeowner with copy of ordinance.  Stephanie is to call fire department if it happens again per Jeremy Scheidel.

It was moved by Scheidel to raise camping fees to $20.  Second by King.

Suzette Byrne and Cathy Humpal let the council know about the bat problem with the city hall and library building.  They are uncomfortable walking with bats in the building.  They would like permission to order bat ultrasonic repelling systems.  Suzette said they are around $60.

The city will no longer share internet with the library. This with the city has more control of the internet service to make sure the city computers remained secured.   Dennis Ungs will work with Hawkeye Telephone Co for internet service.

Since Jason Byrne could not make it to the meeting, Jeremy Scheidel discussed the Lawler All-Nighters with the council.  The All-Nighters are planned for July 16-18.  John Izer is looking for someone or group to run the concession stand and clean up the park after the tournament.  If he cannot find any one he will continue to run the concession stand and clean up the park.

Cathy Humpal discussed the Library Accreditation for the library.  The handy cap sign on the side of the building needs to be turned to face the street.

Discussed the question of the Code of Ordinances regarding solicitor’s permits price.  Motion made by Croell to charge $125 for permit.  Second by Scheidel.

Mellissa Bierman with Chickasaw County Veterans Affairs discussed benefits available for Veterans.  The application process starts at your local VA office.  Her number is 641-394-3232.

Chad Pickar presented a signed letter from his neighbor regarding Chad’s building request to build close to property line. .  Jay had looked over the property and said it would be ok to build close to property line.

Cathy Humpal, Lawler Library Director informed the council Renee Huinker as agreed to another 6 year term as Lawler Library Trustee.  Motion made by King to appoint Renee Huinker to a 6 year term as Lawler Library Trustee.  Second by Scheidel.

EMC Insurance denied the claim of the lightning strike claim of the Well Pump at Highland Park in September 2020.  Since this was denied the city is responsible for the invoice from Northway.  Northway said they would work with city regarding the Budget.   Suzette explained and presented a spreadsheet the city would be able to pay for the Northway invoices yet this fiscal year.

Jeremy Scheidel requested a few quote from John Deere for a ranger for Jay to drive for meter readings.  Suzette presented a spreadsheet with the 5 funds this purchase would affect until the end of the FY20/21.  This has not been budgeted for in the current fiscal or the next fiscal year.  This will be on hold until next budget time in January 2022.

Suzette inquired about Hawkeye Telephone fiber optics.  It will be put on agenda for June.

Nuisance letters were discussed.

The council reviewed the Code of Ordinance draft from Simmering-Cory.   Simmering-Cory listed some questions to be answered and the council went through them.  Suzette will call Simmering-Cory and discuss with them.

Craig Schoenfeld and Neil Jones with Soo Green gave a presentation for the wind energy update.   They plan to start the project in 2023 and finish in 2026.  They will provide a franchise agreement to the city to allow going through the city.  They are planning to follow the CP railroad.

Suzette explained to the council the Ambulance budget could not be raised to $9,000 because the Public Hearing was published at $7,000.  Cities can only decrease budgets not increase budget during the Public Hearing to approve the budget. Instead of budgeting $9,000 for ambulance we had to stay at $7,000.  This has happened with other towns within the county.  I spoke to Stephanie Mashek regarding this and she suggested using funds from this fiscal budget. This will avoid any future amendments to Public Safety fund. We can pay the 1st quarterly payment of $1,950.75) June 8th, 2021.    Mark had explained we will have rent for the ambulance shed.

Irish Fest has purchased a new scoreboard for the ballpark.  They will be donating this to the city.

Gwen would like to start “Pack the Park” on Tuesday nights.  This would involve families to play volleyball, basketball, tennis, or softball/baseball.  This will get residents out to get to know their neighbors.  It could be moved from park to park to utilize the parks in Lawler.

Shane Gruenberg would like to lay rock on the west side of his driveway. Gwen presented a drawing for this and Suzette will have Jay review the drawing.
