The Lawler City Council met in regular session on September 5, 2017 at 7:00 PM.

Mayor Mueterthies presided.

Moved by Izer, seconded by Throndson to approve the Agenda with the following addition:

Bonnie Kuehner, Verna Orvis and Frank Wilson explained information regarding a Community Visioning application for the Crane Creek Trail pond area.   The trail committee could receive up to $80,000.00.  Verna Orvis is filling out the application.  The trail committee will need a $2,000.00 fee from the organization.   The Crane Creek Trail Committee will provide the fee.  The trail committee will need community volunteers to help with this project.  A city representative is also needed.  John Izer volunteered to be on the committee.  If you would like to be on the committee contact Verna Orvis or Bonnie Kuehner.

Motion was made by King to approve the Iowa’s Living Roadways Community Visioning application for the Crane Creek Trail.  Seconded by Scheidel.  All Ayes

Moved by Izer and seconded by Scheidel to approve Bucky’s Liquor license.  All ayes.

The annual Street Finance Report was reviewed.  Moved by Scheidel and second by King to approve the Street Finance Report.  All Ayes.

There were two bids to rent the Farm Land for 4 years.  The highest bid was John Brincks for $4,000.00.  A motion by King to contract with John Brincks for 4 years.  Seconded by Throndson.  All Ayes.

Vacating the alley north of West Main Street in Lawler was discussed.  A motion by King to send letters to the three land owners it will affect, Tom Lensing, Dave Njus and Toni Currans.  If Tom Lensing is interested in retaining the full portion of the alley, he will be responsible for any surveying and lawyer fees.  He will pay the city $2.00.  If Toni Currans and Dave Njus are interested in retaining their position of the ½ the alley they will be responsible for any surveying and lawyer fees.  Also they will pay the City of Lawler $1.00.  Seconded by Izer.  All Ayes.

There will be a community gathering September 10, 2017 at the park for the new trail and playground equipment to say thank you for community help.

Road pavement of North East Street was discussed.  Motion made by King since the road is in fair enough condition the council will readdress this next Spring/Summer.  Seconded by Izer.  All Ayes.

The next meeting will be October 2, 2017 at 7:00pm.

Cleaning wages were discussed.  Cathy Humpal cleans the city hall.  She was paid by the library and the city reimbursed the library for the cleaning wages.  The library board increased her wages and since the cleaning duties are now considered city payroll it was moved by King and seconded by Scheidel to increase the current cleaning wage.  All ayes.

The Farm Lease expires February 28, 2018.  A motion was made by King to send termination letter to John Brincks and run an ad in the newspaper for lease bids to be turned in by September 5, 2017 at 7:00pm.   Seconded by Izer.  All ayes.

The three council members up for reelection are Jeremy Scheidel, Deb Zubrod and Deb Throndson.  Mayor Mark Mueterthies is also up for reelection   Nomination papers can be picked up in the City Hall.

The library levy was discussed.  It was moved by Scheidel and seconded by Izer to give the library $1,160.00.  All Ayes

Mark Mueterthies spoke with John Cuvelier regarding a possible Community Gathering for the new park equipment and trail at Highland Park after Labor Day.   This will be discussed at next month’s meeting.

RAGBRAI was discussed.  The bills and revenues were discussed.  The RAGBRAI committee did a good job with making it a success.  The wall with signatures will be epoxied on Saturday August 12, 2017.

MiEnergy completed an electric study with the City of Lawler and will be raising rates to the city. As a result the City will be raising electric rates 8% effective with the August 2017 billing.
 
RAGBRAI – July 27, 2017
McHugh Street, Grove Street, and Diagonal Street will be closed from 6:00am – 6:00pm for the bike route.
Grove Street will have NO cross traffic, ONLY BIKES!!!

Moved by Scheidel, seconded by King to approve the minutes of the previous meeting with the following the following change, The Department of Agriculture not the DNR was in Lawler to discuss the spaying the ditches along the creek, and to add the flooding situation along the creek and Lawler All-Nighters and approve the bills presented to be paid.  All Ayes.

Suzette discussed the new accounting software and she is still learning the new program.   She introduced new reports which in the long run will be more beneficial for fund accounting.  She is in contact with the accounting software specialist daily.

Stephanie Gillen informed the city that she bought the Mike Leonard property and would like it to remain private.   She does not want the City to pile snow on the property.  It was moved by Scheidel and seconded by Zubrod to terminate the lease with Mike Leonard. All Ayes.

Sheriff Marty Heman was here to discuss RAGBRAI.  He informed the council that the entire department will be working all day.  They are planning to be in Lawler at 8:30am and will be here straight through the time the bike riders are in Lawler.  There will be a deputy directing traffic at McHugh Street and also at Bucky’s.  Shut down is at 3:30pm and the state patrol will be assisting with shut down.  The fire department will be a place to any sick riders to go and relax.   Grove Street will only be open to bikes – no cross traffic.

Marty Heman also discussed the Lawler All-Nighters.  The sheriff’s department will be in town longer than other years.  They will be using ID scanners; wrist bands and be more proactive.

Nuisances were discussed.  It was brought to attention of the counsil of woodchucks and other animals going in and out of vacant house.  This is a public hazard.  Notices will be delivered by the Sherriff.  Fines will be accessed after this notice.

It was moved by Izer and seconded by Throndson to use the meeting room for the Turkey Valley School Board election.

The flooding along the creek was discussed.  Suzette will send notices to the residents along the creek to clean out any brush and trees that have overgrown.   This is slowing up water flow and causing flooding problems.

It was discussed to close the intersection of Grove Street and Hwy 24 and the intersection of Diagonal Street and Grove Street for the Lawler All-Nighters.  It was moved by King and seconded by Izer to close the streets.  All Ayes.

Delinquent accounts were discussed.

Suzette Byrne discussed the new accounting software.  Installation and training will be June 7th, 8th, 14th and 15th.  The city hall will be closed those days.

Gail Stammeyer with Crane Creek Trail discussed a thank you monument listing all who donated time and materials for the trail at Highland Park.   Also, the committee would like to hang a plexy glass frame on the outside of the restroom wall at Highland Park describing the phases of the trail.    A resident would like to donated park benches and a possible water fountain to the Highland Park.

John Izer discussed the Lawler All-Nighters with the council.  He will be running the All-Nighters, including concessions, streets and port-a-pottys.   He has discussed with Jason Byrne the rules and regulations regarding the games.  John will also be speaking with the Chickasaw County Sheriff Department.  No trespassing signs need to be put up by home owners by the ball field.  John will be taking gate.  He has 13 volunteers.

It was moved by Scheidel and seconded by King to open the public hearing.

Concerns from residents were discussed.  Linda Alexander was concerned about how it would affect snow removal.  Jay informed her that the snow removal will not be affected.  John Izer spoke with 3 different realtors regarding property value.  They all said that the closures will not affect the homeowner’s property values.

It was moved by King and seconded by Zubrod to close the public hearing.

It was moved by Scheidel and seconded by Izer to permantly close Center Street and Brush Street and keep Depot Street, Benz Street and Lincoln Street open with flashing lights and cross arms passing Resolution NO. 04032017.   All Ayes.

Diane Gebel was here to represent Irish Fest.  Everything will be set up the same at the previous year.  Chickasaw County Sheriff will help control traffic during parade.  The committee asked for permission to set up a petting zoo in Croell Park.   It would be ok, however they would need their own water since there is no water in the Park.

Cathy Humpal informed the council regarding two new board members to replace Pat Sheridan and Karen Franzen.  Steve Lynch and Renee Throndson accepted the positions.  It was moved by Izer and seconded by Throndson to appoint Steve Lynch and Renee Throndson to the Library Board.  All ayes.

Karen Wilson was here to discuss dog owners not cleaning up after their dogs.  She presented and article regarding the reasons to clean up after you pet.   She spoke with New Hampton and they charge a fine for not cleaning up after pets.   She requested to have signs installed at the city parks regarding cleaning up after dogs.  Suzette will type up an ordinance for pet owners to take responsibility to clean up after their pets.  It was moved by King and seconded by Throndson for Karen Wilson to order 6 signs from Sandy’s Sign Shop.  All Ayes.

The Chickasaw County Coalition discussed progress that the County and the City has done with underage drinking.  Carol Hopp went over the Summer/Fall 2016 Park Assessment Results.  She discussed a list of the Best Practices and Room for Improvements for 3 events, Parks, Irish Fest and the All- Nighters.   The Chickasaw County Sheriff will be available for Irish Fest and Ragbrai.

MiEnergy completed an electric rate study for the city.   It was being recommended to raise electric rates 8% since the cities wholesale rate increase 6%.

King moved to raise electric rates by 8% effective with the August 2017 billing since it has been close to 10 years since the last electric rate raise.   Seconded by Izer.  All ayes.

An ordinance relating to RAGBRAI activities with the City of Lawler was presented to the Council.

It was moved by King to pass 1st and 2nd readings of the ordinance.  Seconded by Scheidel.  All Ayes.

It was moved by Scheidel to pass the RAGRAI Ordinance No. 06052017 and seconded by Zubrod.  All Ayes.

RAGRAI will be here Thursday, June 8, 2017 for their inspection ride of the route.  John Izer will go over the map of vendors with them.  Currently, the city is on schedule for the event.

A Residential Lease Agreement for the use of Mike Leanard’s property for snow removal was presented to the council.  With recommendation from the City Attorney to change one paragraph in the Agreement regarding responsibility of liabilities and lawsuits to be replaced with Indemnification language.

A motion made by King and seconded by Zubrod to accept the Residential Lease Agreement with the attorney recommendation.  All Ayes.

Deb Zubrod planted flowers around the Croell Park sign and band stand.  Would like to put wood chips around band stand.  Croell Park is ready for the slide and diggers to be installed.

Wages were discussed for Jay Uhlenhake and Suzette Byrne.

A motion made by Izer and seconded by King to give the two employees a 1.5% raise effective July 1, 2017.  All ayes.

The DNR was in Lawler to discuss a resident spraying the ditches all a creek.   After walking along the creek it was noticed that a something in a barrel was spilled into the creek.  It will take 2-3 weeks for the DNR assess the damage.

It was moved by King and seconded by Izer to approve Lawler Irish Fest Liquor license.

It was moved by Izer and seconded by Zubrod to approve Bucky’s cigarette license.

John Izer discussed RAGBRAI.  There are now 7 on the committee.   The 1st of June RAGBRAI will be doing a trial run.  Need volunteers.

It was discussed that someone with a BB gun has shot out a window on the west side of town.  Please spread the word if anyone sees anyone shooting a BB gun at homes.

It was moved by Zubrod and seconded by Izer to open the Public Hearing regarding the Railroad.  Mayor Mueterthies discussed the DOT will pay 90% through a grant for installing lights and cross arms and the Railroad would pay with remaining 10% if the city closes Center Street and Brush Street.   The paperwork for the grant needs to be turned in by July 1, 2017.  Homeowners voiced their concerns of the closing of the streets.  Mayor Mueterthies said the railroad will not negotiate the road closings.

Motion made by Zubrod to close Center Street and Brush Street.  No second was made.

King made a motion to table Street closing until next meeting June 5, 2017 with a public hearing at 7:15pm.   Izer seconded.  All Ayes.

John Cuvelier discussed insurance.  It was discussed that certain vehicles with which have full coverage may need to look at to lower premiums.  Also, cyber solutions was discussed. The council may want to look at a higher coverage regarding cyber solutions.  Also, a recommendation from John was to look more closely at segregation of duties.

Bids from Roger Dreckman and Blacktop Service were reviewed and discussed regarding intersections on Grove Street and Benz Street and Grove Street and Depot Street.  The council decided that concrete would last longer than blacktop.  It was moved by King and seconded by Izer to have Roger Dreckman fix the intersections on Grove Street.

Roger Dreckman also presented 7 estimates to replace curb and gutter and install handicap mats on the corners.

Moved by King, seconded by Throndson to accept Estimate 1 to remove and replace curb and gutter along Grove Street and install handicap mat on the SE corner of Grove and Depot.  All ayes.

Moved by Izer and seconded by Throndson to accept Estimate 2 to remove and replace curb and gutter and install handicap mats NE corner of Grove and Benz.  All ayes.

Moved by King and seconded by Zubrod to accept Estimate 3 to remove and replace curb and gutter and install handicap mats NE corner of Grove and Depot.  All ayes.

Moved by King and seconded by Izer to accept Estimate 4 to remove and replace curb and gutter north side of Grove and east of Benz. All Ayes.

Moved by Izer and seconded by King to accept Estimate 5 to remove and replace curb and gutter south side of telephone office only if Windstream replaces the sidewalk in front of building.  All Ayes.

Moved by Izer and seconded by King to accept Estimate 6 to remove and replace curb and gutter SE corner of Starlite Ballroom.  All ayes.

Move by Izer and seconded by Throndson to accept Estimate 7 to remove and replace gutter corner of Diagonal and Larry’s Service.  All Ayes.

Street shoulders were discussed.  The city will need to scrape some yards to help prolong the maintenance of the city streets.  Jay will get names and Suzette will send a letter to the residence whose yards need to be scraped.

Delinquent accounts were discussed.

City of Lawler–Public Hearing Notice

PUBLIC HEARING NOTICE

The City of Lawler is hereby serving as Public Notice that on May 1, 2017, at 7:15 o’clock p.m., the City Council will hold a public hearing at City Hall to update residents of the community on possible road closings of Center Street and Brush Street.

This meeting will be held to provide residents with information concerning the railroad crossings.  Citizens are encouraged to attend and provide their input about the project.  Anyone having questions about the project or anyone requiring special accommodations to attend the hearing such as handicapped accessibility or translation services, may call the City Clerk at 563-238-3614.

The Lawler City Council met in regular session on April 3, 2017 at 7:00 PM.

The Lion’s Club will not have the concession stand at Lawler All-Nighters.

Eric Fibikar with the Lawler Fire Department apologized for not communicating with the city for their training and turning water rusty. He will  work with the city next time they need to train.

Brittney Smith and Janice Sabelka discussed their new business of  B&J Good Eats, LLC DBA Hole in the Wall.  They were requesting a liquor license approval.

Moved by King and seconded by Izer to approve liquor license.  All Ayes.

Moved by Izer and seconded by Zubrod to renew Bucky’s liquor license.  All Ayes.

Moved by Scheidel and seconded by Izer to renew Brite Spot liquor license.  All Ayes.

Ashley Ewing reported that she will be moving one of her dogs by May 5, 2017 bringing total dogs down to 3.  She is working to keep barking under control.

RAGBRAI – The possible route through Lawler is McHugh to Grove to Diagonal.

A discussion of cross arms and lights to be installed at the intersections of Depot Street, Lincoln Street and Benz Street at the railroad crossings.   The DOT will pay 90% of the cost.  Canadian Pacific has agreed to pay the remaining 10% with permanent road closures of Center Street and Brush Street.  The city’s cost would be barricades and signage.  It was moved by Scheidel to set a Public Hearing May 1, 2017 at 7:15p.m. for notification to residents living on the streets for closure.  Seconded by Izer.  All Ayes.

An Energy Rate Study was discussed.  Star Energy Service will be conducting the study.  The cost to the city is $600 plus trip from LaCrosse and MiEnergy will pay $600.  It was moved by King and seconded by Zubrod.  All Ayes.

Nuisance complaints were discussed regarding debris, appliances and unlicensed vehicles and licensed vehicles that have not been move within 48 hours.  Letters and copy of the ordinance will be sent to those individuals who are in violation.

Two CD’s that are up for maturity were discussed.  A motion was made by King to cash them out and deposit on the general fund.  Seconded by Izer.   All Ayes.

Delinquent accounts were discussed.  A motion was made by Izer to send a letter to resident regarding their utility account to be paid in full by April 18, 2017 or disconnect and will be taking them to small claims to have wages garnished.  This is a result of not meeting the contract agreement.

Seconded by King.  All Ayes.

Moved by King, seconded by Zubrod  to adjourn the meeting at 8:30 PM.  All Ayes.
