NOTICE OF PUBLIC HEARING

ON PROPOSAL TO LEASE CITY LAND

 

The Lawler City Council will hold a public hearing on January 3, 2022, at 7:10 p.m. local time in the meeting room of the Lawler City Hall located at 414 E Grove St, Lawler, Iowa to hear comments for and against proposal to lease the following City owned real estate:

 

Approximately 22 acres located in Parcel I of the survey of the Southwest Quarter of the Northeast Quarter of Section 4, Township 95 North, Range 11 West of the 5th P.M., Chickasaw County, Iowa, as shown in Document 2004-0270 in the office of the Chickasaw County Recorder,

 

All in the City of Lawler, Chickasaw County, Iowa;

 

(hereinafter referred to as the “Real Estate”); and

 

WHEREAS, the City Council proposes to lease the Real Estate to John Brincks and Adam Brincks (“Tenant”), upon the terms of a written Farm Lease (the “Farm Lease”), a copy of which is on file with the City Clerk for public inspection, which includes, but is not limited to, the following terms:

 

  1. Possession by Tenant for a term of 4 year(s) to commence on March 1, 2022, and end on February 28, 2026; and
  2. Total annual cash rent for the 1st year of $4,000.00 payable, unless otherwise agreed, as follows: $2000.00 on March 1, 2022, and $2,000.00 on November 1, 2022.  Total annual cash rent for the next 3 years (March 1, 2023 and end on February 28, 2026), of $4,800.00 payable per year, unless otherwise agreed, as follows: $2,400.00 on March 1, 2023, and $2,400.00 on November 1, 2023, and every March 1 and November 1, during the remaining term of the Lease.

 

At said time and place, comments will be received at the public hearing by the City Council on the question of the whether to enter into said Farm Lease on the proposed terms.

ON PROPOSAL TO VACATE AND CONVEY CITY-OWNED REAL ESTATE

 

The Lawler City Council will hold a public hearing on January 3, 2022, at 7:15 p.m. local time in the meeting room of the Lawler City Hall located at 414 E Grove St, Lawler, Iowa to hear comments for and against proposal to vacate and convey City-owned real estate to Croell, Inc., and more specifically described as follows:

 

A parcel of Diagonal Street described as follows:

 

Right-of-Way Reversion Parcel #1, Project Number: 2021 Diagonal Street in the Southwest Quarter of the  Southeast Quarter of Section  4, Township 95 North, Range 11 West of the  5th P.M., City of Lawler, Chickasaw County, Iowa, and  more  particularly described as follows:

 

Commencing at the South  Quarter Corner  of said Section;

 

Thence  North 88°16’02” West, 130.97 feet along  the  Centerline of Iowa  Highway 24;

 

Thence  (C2) Northeasterly 847.29 feet along a 1145.92 foot  Radius Curve, Concave  Northwesterly (said  Curve  having a long  chord  of North  67°05’06” East, 828.12 feet)  along  said Centerline to the Southerly Extension of the  Northeasterly Right-of-Way Line of Diagonal Street;

 

Thence  North 42°10’48” West, 50.03 feet along  said Southerly Extension to the Intersection of the North  Right-of-Way Line of Iowa  Highway 24 and the  Northeasterly Right-of-Way Line of Diagonal Street;

That if the City Council does approve the vacation of the Vacation Parcel, that the City proposes to convey said Vacation Parcel to Croell, Inc., by a properly executed Quit Claim Deed and that said conveyance shall be “as is”, for the consideration of $500.00 and payment of all City expenses related to the transaction, including but not limited to legal fees and publishing costs, as well as the City reserving a utility easement upon and across the Real Estate.

 

At said time and place, comments will be received at the public hearing by the City Council on the question of the vacation and conveyance of said parcel of real estate.

Kurt Croell had Herold-Reicks Surveying survey the new build at Bucky’s.  The building is on a portion of city property.  Kurt Croell informed the city he will purchase the property for $500.00 and take care of all expenses to sell.

Motion made by Izer to sell property to Kurt Croell for $500 and all expenses.  Second by King.

Motion passed.

Mark Mueterthies, Jay Uhlenhake and Kurt Croell met with Iowa Homeland Security and Emergency Management for state funding for flooding.    The city is working with them for funding to make the channel wider going through town.  Some property may be lost to do this project to help flooding within the city.

Cathy Humpal discussed security cameras for the library.  The company the library is going through wanted to know if the city would be interested.   The library said they have a quote for $3,000 and plan to cash in a CD to pay for it.

Suzette explained Northeast Iowa Community Action Corporation is launching a new program. LIHWAP an emergency program that will help low-income households and families afford water and wastewater services.  This is to help residents pay past due water and wastewater bulls, avoid shutoffs, and regain disconnected accounts.

Motion made by King to approve LIHWAP.  Second by Izer.

The council reviewed the Annual Financial Report for approval.

Motion made by Izer to approve the Annual Financial Report. Second by Croell.

The council reviewed the Farm Lease with John Brincks to decide when they are ready to approve lease.  This will be on December agenda.

The furnace that heats the library and community room is 30 years old and the controller went out and is too big.  The city received bids from Geerts Plumbing & Heating and Mic’s Plumbing and Heating.  We could possibly sell the old finance.

Motion made by Croell to approve Mic’s Plumbing and Heating bid.  Second by Izer.

Motion passed.

Mark gave an update on the Chickasaw Ambulance.  The contract will terminate June 2022.  The next ambulance meeting will be November 21, 2021.

Mark is trading his personal ranger with Drillings and is working out for Drillings to sell to city.  He would like a consensus with council on the December agenda.

Delinquent accounts were discussed.

The next meeting will be Monday, December 6, 2021 at 7:00 p.m.
